Terms of service

These Terms of Service ("Terms") govern your access to and use of TasteFlights at tasteflights.com, including business accounts, customer journal accounts, and public tasting menus accessed via QR code (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy policy. If you do not agree, do not use the Service.

Agreement to terms

TasteFlights is operated by an individual proprietor doing business as TasteFlights ("Company," "We," "Us," or "Our"). These Terms form a binding agreement between you and the Company.

If you use the Service on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.

You must be at least 18 years old to create a business account. Customer accounts require you to be at least 16 years old, or the age of majority in your jurisdiction if higher.

Description of service

TasteFlights provides branded mobile tasting menus, customer rating and journal features, inventory tools, AI-assisted label scanning, QR code generation, and business analytics for wineries, breweries, distilleries, and tasting rooms.

The Service includes:

  • Business accounts — paid subscriptions with an admin and up to five invited flight builders who can manage inventory, banners, and menus.
  • Public tasting menus — customer-facing menus at unique URLs, reachable via QR code, where visitors can rate beverages and optionally save tastings.
  • Customer accounts — free journal accounts where customers store saved tasting snapshots, ratings, and notes.
  • Analytics — aggregate usage data for business subscribers (for example, QR scans and rating statistics).

The Service is provided as a web application and installable progressive web app (PWA). Features may change over time. We do not guarantee compatibility with every device or browser.

Business accounts

Each paying organization should maintain one business account. The account admin may invite up to five flight builders. Invited users must use the email address to which the invite was sent.

You are responsible for maintaining the confidentiality of account credentials and for all activity under your account and your team's accounts. Notify us promptly at hello@tasteflights.com if you suspect unauthorized access.

You represent that information you provide (including business name, contact details, and menu content) is accurate and that you have the right to upload and publish that content.

Admin-only actions (such as deleting inventory, managing billing, and sending team invites) are restricted to the business admin role. Flight builders may create and edit menus and inventory within the permissions of their role.

Subscription, trial, and billing

Free trial. New business accounts receive a 14-day free trial. During the trial, you may use the Service subject to these Terms and applicable usage limits.

Paid subscription. After the trial, continued use of business features requires a paid subscription at $19.99 USD per month, unless otherwise stated at checkout. Prices are subject to change with reasonable notice to existing subscribers.

Payment processing. Payments are processed by Stripe. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis until you cancel. You are responsible for keeping your payment information current.

AI label scan limits.

  • During the free trial: up to 40 AI label scans.
  • On a paid subscription: up to 100 AI label scans per billing period.
  • Scans above the paid monthly cap are billed at $0.29 USD per scan.
  • Scan counts reset when a successful invoice payment is processed for your subscription period.

If you exceed your scan quota and do not have a valid payment method on file for overage billing, AI scanning may be unavailable until the next billing period or until you add payment information.

Taxes. Prices exclude applicable taxes unless stated otherwise. You are responsible for any sales, use, or similar taxes associated with your subscription, except taxes based on our net income.

Failed payments. If a payment fails, we may retry charges, suspend access to paid features, or terminate your subscription after reasonable notice.

Cancellation. You may cancel your subscription at any time through the Stripe customer portal available from your account page. Cancellation takes effect at the end of the current billing period unless otherwise required by law. You will retain access to paid features through the end of the paid period.

Refunds. Subscription fees are non-refundable except where required by applicable law. Because the trial period is free, no refund applies to trial usage. If you believe you were charged in error, contact hello@tasteflights.com within 30 days of the charge.

AI label scanning

AI label scanning uses automated vision to suggest beverage fields (such as name, producer, style, vintage, ABV, and region). Suggested fields are estimates only and may be incomplete or inaccurate.

You must review and edit all AI-suggested fields before saving inventory items. You are solely responsible for the accuracy of inventory and menu content you publish.

We do not guarantee that AI scanning will work for every label, image quality, or beverage type. If the Service cannot read a label clearly, you may enter information manually.

To the fullest extent permitted by law, the Company is not liable for errors in AI-extracted data or for business decisions you make based on suggested fields.

Acceptable use and content

You agree not to misuse the Service. Prohibited conduct includes, without limitation:

  • Uploading illegal, infringing, defamatory, harassing, or otherwise harmful content.
  • Uploading malware or attempting to disrupt, scrape, reverse engineer, or overload the Service.
  • Circumventing scan quotas, rate limits, access controls, or authentication.
  • Impersonating another person or business, or misrepresenting your affiliation.
  • Using the Service to send spam or unsolicited communications.
  • Reselling or sublicensing the Service without our written permission.
  • Accessing customer ratings or notes through the Service in ways not expressly permitted (business subscribers receive aggregate analytics only).

Your content. You retain ownership of content you upload (including beverage details, images, banners, and menu text). You grant the Company a worldwide, non-exclusive license to host, store, reproduce, display, and process your content solely to operate and improve the Service — for example, to render public menus, generate QR codes, run AI label scanning on images you submit, and provide analytics.

We may remove content or suspend access if we reasonably believe it violates these Terms or applicable law.

Customer accounts and public menus

Customer journal accounts are free. Public tasting menus are accessible via QR code or direct link without an account; however, saving a tasting to a journal requires a customer account.

When you save a tasting, the Service stores a snapshot of the menu and your ratings and notes at the time of save. If a business later edits or removes menu items or inventory, your saved journal entry is not automatically updated — it reflects the menu as it appeared when you saved it.

Customers own their ratings and notes. Business subscribers receive aggregate analytics only (for example, scan counts and rating statistics) and do not receive access to individual customer notes through the Service.

Customers may update ratings and notes on saved journal entries. Businesses must not attempt to identify individual customers or their private notes except as permitted by law or with the customer's consent.

Magic-link sign-in requires you to open the link in the same browser session that requested it, due to security requirements of our authentication provider.

Intellectual property

The Service, including the TasteFlights name, logo, software, design, and documentation, is owned by the Company or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks except as necessary to use the Service as intended.

You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor may you reverse engineer or attempt to extract the source code, except where applicable law expressly permits.

Feedback you provide about the Service may be used by us without restriction or compensation to you.

Disclaimers and limitation of liability

As-is service. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that data will not be lost or altered.

TasteFlights is a technology platform. We do not sell alcohol, verify age for alcohol consumption, or control how businesses use menus in their tasting rooms. Businesses are responsible for compliance with applicable beverage-alcohol laws and regulations.

Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless the Company and its operator from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your content; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any law or the rights of a third party.

Termination

You may stop using the Service at any time. Business subscribers may cancel paid subscriptions through the Stripe customer portal as described above.

We may suspend or terminate your access to the Service immediately if you materially breach these Terms, fail to pay amounts due, or use the Service in a way that poses risk to us or other users. Where reasonable, we will provide notice before suspension or termination.

Upon termination, your right to access the Service ends. Provisions that by their nature should survive (including payment obligations accrued, intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive termination.

We may retain and use data as described in our Privacy Policy and as required by law. You are responsible for exporting any content you wish to keep before cancellation where the Service provides export capability.

Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles, except where federal law applies.

Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Sacramento County, California, and you consent to personal jurisdiction in those courts.

Before filing a claim, you agree to contact us at hello@tasteflights.com and attempt to resolve the dispute informally within 30 days.

If you are a consumer in a jurisdiction that grants you mandatory rights that cannot be waived by contract, those rights remain unaffected.

Changes to these terms

We may update these Terms from time to time. When we do, we will post the updated Terms on this page and update the "Last updated" date. For material changes affecting business subscribers, we will make reasonable efforts to notify you by email or through the Service before the changes take effect.

Your continued use of the Service after updated Terms become effective constitutes acceptance of the changes. If you do not agree to updated Terms, you must stop using the Service and cancel any paid subscription.
